독일의 스포츠계에서 인권침해 사례는 거의 보고된바가 없다. 독일이 한국처럼 스포츠계에서 인권침해 현상이 현저히 낮은 이유는 스포츠에서의 인권침해 문제는 결국 대부분은 아동의 인권문제와 결부되어 있기 때문이다. 독일기본법 제2조 제2항은 “누구든지 생명·신체에 대하여 침해받지 않을 권리를 갖는다. 신체의 자유는 불가침이다. 이 권리는 법률에 의해서만 제한할 수 있다”고 규정하여 생명과 신체에 대한 침해를 금지하고 있다. 독일에서 교사가 학생에게 예컨대 뺨을 때리거나, 귀를 잡아당기거나, 밀치는 경우 등은 상해죄로 처벌되며, 욕설이나 모욕적인 발언를 하는 경우는 모욕죄, 뒤에 나가서 서있게 하는 행위 등은 그 정도에 따라서 학대의 죄나 강요죄로 처벌될 수 있다. 독일에서는 심지어 자녀에 대한 체벌도 금지되어 있다. 이와 같이 독일에서는 부모조차도 체벌이 금지되어 있고, 학교에서 교사의 체벌은 범죄행위로 간주되는 분위기에서 아동 청소년의 스포츠 영역에서의 인권침해 현상을 발을 붙이기 어려운 것이 현실이다. 인권이 배제된 스포츠는 더 이상 존재가치가 없다. 인권이 결부된 스포츠야 말로 그 자체로 사회적 가치를 지니게 된다. 인권이 내재된 스포츠는 현재 우리가 다음 세대를 위한 지속가능한 발전을 가능하게 하는 수단이 된다.

There have been few reports of human rights violations in the German sports community. The reason why Germany has a significantly low human rights violation phenomenon in the sports world is because most of the human rights violations in sports are linked to children’s human rights issues. Article 2 (2) of the German Basic Law, "Anyone has the right not to be infringed on life or body. Freedom of the body is inviolable. This right may only be restricted by law, and the right to non-aggression against life and body is prescribed. In Germany, if a teacher punishes a student, he or she can be punished for injury, such as physical contact, such as hitting, pulling ears, or pulling hair. If he or she is abusive or insulting, he or she can be punished for abuse or coercion. In Germany, corporal punishment for children is even prohibited. As such, even parents are banned from segregation in Germany, and it is difficult to set foot on human rights violations in the sports area of children and adolescents in an atmosphere where corporal punishment by teachers in schools is considered a criminal act. As we saw earlier, sports where human rights are excluded may no longer be worth their existence. A sport involving human rights has social values in itself. Sports with built-in human rights are now the means by which we enable sustainable development for the next generation.
